Criminal case opened on the fact of non-payment of taxes by LLC  "Spayka"

ArmInfo. Spayka LLC concealed a  real turnover from the Armenian tax authorities, as a result of which  the state budget of Armenia failed to receive taxes in the amount of  AMD 2 billion.

As SRC reported, on July 9 2018, from the Tax Inspectorate of large  and medium taxpayers of SRC, the Investigation Department received  the results of a preliminary study in Spayka on violations in the  period 2015-2018 and unaccounted tax liabilities.

On the basis of a report in the Investigative Department of the RA  SRC, materials on articles 180-181 of the RA Criminal Code have been  prepared. Received factual data that the company "Spayka" from  January 1, 2015 to April 30, 2018 exported 61.084.701 kg of tomatoes  in amount of 18.671,808.672 AMD to the countries of the EAEU, mainly  to Russia.  At a minimum, the sale of 44,912,368 kg of tomatoes by  company officials were submitted at unreliable prices: 1 kg of tomato  was declared at a price of from 105.28 to 373.43 AMD, while at that  time the price, both in Armenia and in Russia, was much higher.

As a result, in calculating the profit tax of the resident, submitted  to the tax authority for 2015- 2017, the company, concealed the  turnover, at least, in the amount of 10,226,412,296 AMD.  As a  result, a smaller amount of profit tax was charged for the reporting  period, and 2,045,282,459 AMD was not paid to the state budget. On  July 13, 2018, the Criminal Investigation Department of Armenia  instituted criminal proceedings under Part 2 of Art. 205 of the RA  Criminal Code.

Earlier, on July 3, ArmInfo informed that on the basis of the  decision of the Yerevan general court, on July 3, the officers of the  Office for Detection of Offenses and Administrative Proceedings, as  well as the Office of the Operative Investigation Department and the  Office for Combating Organized Crime, conducted joint search on the  territory of LLC "Spayka". It should be noted that according to  rumors, Spayka, the largest transport company in Armenia, which also  deals with purchases and production of canned agricultural products,  is associated with RA former President Robert Kocharyan and the  son-in-law of the 3rd President Mikael Minasyan.
