Changes in RA Labor Code introduced in parliament

ArmInfo.The Ministry of Labor and Social Affairs initiated amendments to the Labor Code of the Republic of Armenia and the Code of Administrative Offenses of the  Republic of Armenia, which are aimed at simplifying legal relations  between the employer and the employee, clarifying the rules of the  game, in particular in the context of the spread of coronavirus. 

Deputy Minister of Labor and Social Affairs Arman Udumyan stated this  from the rostrum of the National Assembly of the Republic of Armenia  on April 28.

First of all, according to him, the concept of distance work will be  introduced in the Labor Code, in the process of organizing which the  payment of wages to employees in full is provided. In addition, the  remote organization of work does not provide for significant changes  in the employment contract.  At the same time, within the framework  of the stipulated changes, the employer may not pay the employee for  the forced downtime, however, these transformations will not affect  the areas approved by the Commandant. At the same time, by decision  of the employer, the fee for forced downtime may be higher than the  current threshold (at least 2/3 of the average wage). In addition,  the changes imply the right for the employee to demand unused  vacation.

As the Deputy Minister of Labor and Social Affairs Arman Udumyan  noted in his speech, in view of the prevailing conditions, employers  are not entitled to terminate the employment contract or apply a fine  to an employee who is unable to arrive at the workplace or who  arrived late to work.

The foreseen changes oblige employers not to reduce the amount of  wages to employees who, due to the closure of educational  institutions, were unable to arrive at the workplace in a timely  manner. Allowed lateness is 2 hours. If the employee was delayed for  more than 2 hours, then the salary will be paid according to the  actual amount of work performed, working hours.

He noted that this issue will be discussed tomorrow at a meeting of  the RA Permanent Commission, after which it will be re-represented in  the RA Parliament. It should be noted that the package of draft laws  on introducing amendments to the Labor Code of the Republic of  Armenia and the Code of Administrative Violations of the Republic of  Armenia was adopted in the first reading by a majority of votes of  the deputies of the National Assembly of the Republic of Armenia.
