ArmInfo.Minimum requirements for insuraring passengers, flight crew and service personnel will be established for all air carriers and aircraft operators in Armenia.
The draft of the relevant law has been submitted for discussion on the e-draft.am website. If adopted by the National Assembly of the Republic of Armenia, the law will apply to all air carriers and aircraft operators operating flights within the territory of the Republic of Armenia, outside the territory of the Republic of Armenia and through the territory of the Republic of Armenia. The provisions of this law shall not apply to state aircraft, aircraft with a maximum take-off weight of less than 20 kilograms, hang gliders, hot air balloons, helicopters and ultra-light aircraft used for domestic flight training that do not involve crossing international borders. The document introduces such concepts as air carrier, aircraft operator, third party, passenger, and commercial transport.
Insurance of air carriers and aircraft operators will be carried out in terms of special aviation liability to passengers, flight and maintenance personnel, baggage, cargo and third parties. Insurance risks include military operations, terrorism, hijacking of aircraft, sabotage operations, illegal seizure of aircraft and civil unrest. Air carriers and aircraft operators will be required to ensure that insurance cover is in place for each flight, regardless of whether the aircraft they operate is under their ownership or under any lease agreement, joint operation or complex business authorization (franchising), usage codes or any other similar agreement. Air carriers, and, if necessary, aircraft operators, prove compliance with the insurance requirements by submitting the insurance certificate or other evidence of valid insurance to the competent authorities of the Republic of Armenia. In exceptional cases of failure of the insurance market, the Government of the Republic of Armenia may establish temporary special provisions for the application of the liability insurance system. The minimum passenger liability insurance coverage, except for non- commercial transportation by aircraft of 2,700 kg or less, is at least 250,000 SDRs (Special Drawing Rights) per passenger.
The minimum insurance cover for flight and maintenance personnel liability, except for non-commercial transport by aircraft of 2,700 kg or less, is at least 250,000 SDRs per member. The minimum insurance coverage for non-commercial carriage by aircraft of 2,700 kg or less GVW is at least 100,000 SDRs per passenger. The minimum insurance coverage for baggage liability is 1288 SDRs per passenger in the scope of commercial transportation. The minimum insurance coverage for cargo liability is 22 SDRs per kilogram in commercial transportation.
