ArmInfo. From 2019 to 2024, 10,779 lawsuits were filed against the State Revenue Committee (SRC) of the Republic of Armenia. Only 1,257 court decisions were made in favor of the SRC, 7,163 against, the rest are under investigation. It turns out that the SRC loses about 80% of court cases. Meanwhile, business and the economy suffer, and the country's reputation is irreparably damaged. 1. Step one. The State Revenue Committee makes a (which, as we remember, will be 80% incorrect). As soon as the alleged violation of the exceeds 10 million drams, the State Revenue Committee transfers the case to the Investigative Committee for investigation.
2. The Investigative Committee has no right not to respond to the application and initiates a criminal case against the business, and often takes tough measures, such as prohibiting the business's activities, detaining the entrepreneur, against the business and other similar actions in the style of anti-terrorist activities.
3. The businessman either goes to prison or, if he can, pays the amount calculated on the basis of the State Revenue Committee's and does not go to prison.
4. The businessman files a lawsuit against the State Revenue Committee, because he is sure that the came to an incorrect figure, and we already know that statistics show that in 80% of cases the State Revenue Committee loses due to incorrect calculations.
5. As a result, we have a business paralyzed for 1-2-3 or 6 months, the development of which stops or regresses, tax revenues from the business decrease, the entrepreneur loses motivation to develop in the legal space of the Republic of Armenia, etc.
6. During this entire period, the State Revenue Committee makes excuses, saying that it was the Investigative Committee that delayed it, and we had nothing to do with it. The Investigative Committee, in turn, states that we could not help but take action, since the State Revenue Committee made the calculations and contacted us, and we cannot help but respond.
As a result of such unfair and illiterate steps, businessmen, the environment, understand that Armenia is not a suitable place for doing business, since any businessman can at any time receive the status of a terrorist and can be treated as such. Can you imagine the economic consequences of this atmosphere of fear?
I have a businessman friend, he has now moved to the United States, he always repeated that any businessman in Armenia is a criminal, no matter what he does, we are simply free until the State Revenue Committee decides to deal with us. He meant that due to our legislative framework, anyone can be found guilty and convicted, and then it will turn out that they were tried on the wrong topic, but it is too late>, - the head of the Union noted.
Mirakyan is convinced that the State Revenue Committee definitely does not imagine, does not calculate and does not set the task of taking into account the economic consequences of its activities. The State Revenue Committee inspectors receive a bonus for each fine, regardless of whether this fine will subsequently be cancelled with an 80% probability or not, but the tax inspector will receive his bonus in any case, and for him this is the most important thing.
Meanwhile, Vahram Mirakyan calls for: not to initiate criminal cases without a proper tax audit, only on the basis of assumptions; to abandon the repressive style of work; to reconsider the current model of relations between the state and business, where the businessman is considered the main culprit; to introduce a mechanism for economic calculation of damages, including based on the results of the State Revenue Committee's activities or investigative actions; to introduce the institution of mutual responsibility.
